Welcome to Fixly. These Terms of Service ("Terms") govern your access to and use of the Fixly website, mobile app, and related services (together, the "Service") operated by EC Rental Property Management, LLC ("Fixly", "we", "us"). By using Fixly you agree to these Terms.
1. What Fixly is
Fixly is a two-sided marketplace that connects homeowners, renters, and property managers ("Customers") with independent service professionals ("Pros") for on-demand home services, including property inspections, cleanings, handyman work, yard care, and smart-home installs.
Fixly is not the provider of the services listed. Pros are independent 1099 contractors who are solely responsible for the work they perform.
2. Eligibility
You must be at least 18 years old and legally able to enter into contracts. Pros must additionally maintain any licenses, permits, or insurance required for the work in their jurisdiction.
3. Booking, payment & fees
Prices are shown at checkout and are charged in full at the time of booking through our payment processor. By booking a service you authorize us to charge your payment method for the full listed price, applicable taxes, and any additional agreed-upon work.
4. Cancellations & refunds
Cancellations and refunds are governed by our Refund Policy.
5. Conduct
You agree to provide accurate information, treat other users respectfully, and not use Fixly for anything illegal, fraudulent, or harmful. We may suspend or remove accounts that violate these Terms.
6. Pros as independent contractors
Pros are independent contractors, not employees of Fixly. Fixly does not control the manner or means by which Pros perform services. Pros are responsible for their own taxes, tools, insurance, and compliance with local law.
7. Ratings, reviews & content
You retain ownership of content you submit (reviews, photos, notes), but grant Fixly a worldwide, royalty-free license to use, display, and distribute it in connection with operating and promoting the Service.
8. Disclaimers
The Service is provided "as is" without warranties of any kind. Fixly does not guarantee that any specific Pro will accept a job, or that any specific outcome will result from a service.
9. Limitation of liability
To the maximum extent permitted by law, Fixly's total liability for any claim relating to the Service is limited to the amount you paid Fixly for the specific booking that gave rise to the claim.
10. Changes
We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use of Fixly after the change takes effect means you accept the updated Terms.
